The Romanian Tourism Employers’ Federation (FPTR) and the Mamaia Constanța Employers’ Organization (OPMCTA) have filed a criminal complaint with the Prosecutor’s Office attached to the High Court of Cassation and Justice against the Minister of Economy, Entrepreneurship, and Tourism, Claudiu Năsui, and other ministry officials, whom they hold responsible for abuse of office.
The Romanian Tourism Employers’ Federation (FPTR) and the Mamaia Constanța Employers’ Organization (OPMCTA) have filed a criminal complaint with the Prosecutor’s Office attached to the High Court of Cassation and Justice against Minister Claudiu Năsui and other officials from the Ministry of Economy, Entrepreneurship, and Tourism (MEAT).
In the criminal complaint, FPTR and OPMCTA representatives mention that Minister Claudiu Năsui and the ministry officials are guilty of abuse of office as initiators of Government Emergency Ordinance no. 65/2021, according to FPTR.
The draft Government Emergency Ordinance regarding the amendment of Government Ordinance no. 58/1998 on the organization and conduct of tourism activities in Romania and other normative acts was placed on the agenda and approved in the Romanian Government meeting on June 29, without respecting the 10-day posting period on the website, without the approval of the Social Dialogue Commission within the ministry, without being discussed in the Economic and Social Council (C.E.S.), and without providing a response to FPTR’s request from June 27.
The document in question abolishes tourism attachés, and the organizations accuse that, by doing so, the aim is to contract tourism promotion services from private, “preferred” companies.
According to Art. 175 para. (1) lit. b) of the Penal Code, the persons against whom this complaint was filed have the status of public officials as they exercise a public dignity function, and the adoption and support of a normative act in violation of Law no. 52/2003 on decision-making transparency represents a defective fulfillment of official duties.
