On March 1, 2022, the Ministerial Order establishing the classification procedure for accommodation units operated by individuals was published in the Official Gazette. Thus, short-term rental accommodation units operated by individuals will no longer be able to function unless they have a classification from the Ministry of Entrepreneurship and Tourism.

The purpose of this measure is to reduce unfair competition, specifically the phenomenon of “black tourism,” and implicitly tax evasion. In this rental sector, untaxed income is being collected.

Internal analyses by the MAT show that there are approximately 5,000 structures carrying out such activities.

Any individual can rent out their apartment for tourism purposes, obtaining the classification from the Ministry of Entrepreneurship and Tourism free of charge, the statement mentions.

According to the source, the regulation promoted on Tuesday, March 1, through a ministerial order, is also provided for in Ordinance no. 58 of August 21, 1998, regarding the organization and conduct of tourism activities in Romania.

MAT points out that tourism activities carried out within units located in condominium-type dwellings can affect the daily lives of residents.

„Apartment buildings are not hotels. For this reason, starting from the premise of respecting mutual rights, the ministerial order provides for obtaining consent from neighbors with whom the economic operator shares common walls, in order to obtain the classification certificate.”

According to the Ministry of Entrepreneurship and Tourism, the measure facilitates the introduction of new players into the competitive market, which can lead to an increase in the quality of tourism services.
