A law has been enacted providing for tax and fee exemptions for buildings classified as historical monuments during renovation or rehabilitation works.
The measure will apply from 2025.
The law supplements para.
(1) of Article 456 of Law no. 227/2015 on the Tax Code.
“No building tax shall be due for: buildings classified as historical, architectural or archaeological monuments, regardless of the holder of the ownership or management right, which do not have their street and/or main facade renovated or rehabilitated according to the provisions of Law No 422/2001 on the protection of historical monuments, for the period of carrying out the renovation or rehabilitation works, starting from the date of the building permit and until the date of the final acceptance report on the works carried out, in compliance with the provisions of Government Emergency Ordinance No. 77/2014 on national procedures in the field of state aid, as well as for amending and supplementing Competition Law No. 21/1996″, the draft provides.
Thus, according to the measure, these categories of real estate will benefit from tax exemption during the period of renovation or rehabilitation works, from the issuance of the building permit until the final acceptance of works.
Please note that this exemption will be applied in accordance with State aid legislation.
The exemption will also extend to works already in progress at the date of entry into force of the new provisions.
The act also stipulates that, in the case of renovation or rehabilitation works in progress at the date of entry into force of the law, the exemption will apply until the date of the final acceptance report.
According to the motivation of the measure, the most recent classifications of the Ministry of Culture show that Romania has more than 30,000 historical monuments, many of which require significant rehabilitation, consolidation or renovation works.
