The amendments aim to align the legal framework with market developments, expand digitalization, simplify administrative procedures for operators, and strengthen safety, quality, and accessibility standards.<\/p>\n<p>The new regulations impose additional criteria on hotels, including the implementation of integrated systems for risk management, environmental performance, and smart building management, securing parking spaces for coaches, installing charging stations for electric vehicles, access to Blue Flag certified beaches, or the existence of a treatment facility. For newly established 4- and 5-flower tourist and agritourism guesthouses, air conditioning becomes mandatory nationwide, eliminating the previous limitation to only the seaside and the Danube Delta. Additionally, guesthouses will also be evaluated based on their promotion of local heritage through gastronomic points, craft workshops, and traditional activities.<\/p>\n<p>The legislative changes introduce a 4-star classification for bungalows and establish classification rules for atypical units, such as traditional houses, tiny houses on wheels, or barrels. Operators now have the option to provide informational materials in digital format, via QR codes or mobile applications. At the same time, the normative act regulates for the first time the concept of a &#8220;tourist resort&#8221;, defined according to Law no. 41\/2026 as a unitarily managed complex of accommodation, food, and leisure structures, spread over a minimum area of 10,000 sqm. In addition, new hotels and motels must provide rooms adapted for people with disabilities, and new public catering units must be made accessible in accordance with the NP 051-2012 standard.<\/p>\n<p>On the administrative side, the classification procedure has been simplified by eliminating the obligation to submit the ONRC certificate of status, as the information is verified directly by MEDAT, although operators must still declare their place of business and the relevant CAEN code. The deadline for completing the submitted documentation has been reduced from 6 to 3 months, while the period for rectifying minor deficiencies found on-site has been extended from 7 to 15 business days. Document submission can be done physically or through the situr.gov.ro platform.<\/p>\n<p>In the event of the cancellation of tourism certificates or licenses, operators will submit self-declarations certifying that there are no paid and unfulfilled reservations, or that these have been taken over by another operator under similar contractual conditions. For agencies, the absence of active service packages or unpaid debts to suppliers must be declared.
