Among these modifications: restaurants and hotels should have a period at their disposal to decide whether they want to be taxed under the current system or opt for the fixed tax prepared by the authorities, and small guesthouses, bars, pizzerias, and shaorma shops—excluded from the category of firms that can pay the new tax—are to be reintroduced into the category of beneficiaries, also with the right of option.

In the initially proposed form, all operators in tourism and the food service industry were to benefit from the new taxes, but the project was later modified to exclude micro-enterprises from the beneficiary category.

However, an official document reveals that micro-enterprises may be reintroduced into the category of firms paying the future tax, with a new modification of the project being considered at this time before it is approved by Parliament.

Both micro-enterprises and other operators in the hotel and restaurant industry will have the possibility to choose between the current taxation system and the fixed tax.

The modifications are also driven by the fact that some firms fear the future tax, considering the negative effects of the lump-sum tax introduced by the Government in 2009 at the initiative of the then-Minister of Finance, Gheorghe Pogea, according to the document.

In 2009, the Government decided that firms should pay a minimum annual tax ranging between 2,200 RON, if they have total revenues up to 52,000 RON, and 43,000 RON, for revenues over 129 million RON. The minimum amount imposed for payment led over 130,000 firms to suspend their activity that year.
