{"id":122612,"date":"2016-11-23T00:00:00","date_gmt":"2016-11-22T22:00:00","guid":{"rendered":"https:\/\/rhn.ro\/president-iohannis-promulgates-public-private-partnership-law\/"},"modified":"2026-03-28T15:37:16","modified_gmt":"2026-03-28T13:37:16","slug":"president-iohannis-promulgates-public-private-partnership-law","status":"publish","type":"post","link":"https:\/\/rhn.ro\/en\/president-iohannis-promulgates-public-private-partnership-law\/","title":{"rendered":"President Iohannis Promulgates Public-Private Partnership Law"},"content":{"rendered":"<div>On November 23, President Klaus Iohannis promulgated the Public-Private Partnership Law, which provides methods for financing and executing investment works in a partnership regime between the state and private companies, three years after the project was initiated by the Ponta government and following disputes over controversial provisions.<\/div>\n<div><\/div>\n<div>The law outlines the mechanisms through which projects can be carried out via public-private partnerships, establishing cooperation between the public partner and the private partner for the implementation of a public project, the relatively long duration of contractual relations to allow the private partner to recover the investment and achieve a reasonable profit, project financing primarily from private funds and, where applicable, by pooling private funds with public funds, and the distribution of risks between the public and private partners based on each contracting party&#8217;s capacity to evaluate, manage, and control a specific risk.<\/div>\n<div><\/div>\n<div>Private partners will be able to amortize their investments through a contract that will grant them the right to collect and use, for the project&#8217;s operation, tariffs from the users of the asset(s) or public service forming the object of the public-private partnership project.<\/div>\n<div><\/div>\n<div>The law replaces a similar project, Law 178\/2010, which drew criticism from the European Commission regarding how contracts were awarded and verified.
