Online platforms providing intermediary services between tourists and those renting out their homes on a short-term basis\u2014a category including, for example, Airbnb or Booking.com\u2014could be required to communicate a series of relevant information to public authorities on a monthly basis, according to a draft European regulation soon to be submitted to the European Parliament and the Council.<\/p>\n
The proposed regulation will provide public authorities with relevant data and tools to ensure that only those legally registered to offer short-term rental housing can publish listings on online platforms.<\/p>\n
Currently, the initiative is at the draft stage and is to be discussed for adoption by the European Parliament and the Council. After its adoption and entry into force, the regulation will apply automatically to all European Union (EU) member states, including Romania; however, authorities will need to establish the necessary mechanisms for data exchange through national normative acts.<\/p>\n
The information that will reach public authorities automatically every month refers to data on the number of nights stayed and guests, the registration number of the accommodation unit, as well as the web address of the online platform. In the case of small or micro-platforms, these data will be transmitted manually to public authorities every three months.<\/p>\n
Although the draft regulation aims to share only the data listed above, platforms will be obliged to share other data as provided for in other European legislative acts, such as data for tax authorities regarding income generated from short-term rentals.<\/p>\n
The information received will help public authorities identify those listing rental properties without being registered for this purpose.<\/p>\n
